TWO STAGE PROCESSING

From 1 March 2003, the Australian Government changed Business Skills visa regime.

  • There are Provisional visa subclasses and Permanent Resident visa subclasses.
  • There is a two stage process for Provisional visa subclasses
    1. Four year visa.
    2. After two years of business activity or four years of investment the visa holder is eligible for permanent residence.

For high calibre business migrants, permanent residency is available from the beginning under Business Talent (Migrant) visa subclass 132.

  • Business Skills (Provisional) Class UR
    • Business Owner (unsponsored/sponsored)
    • Senior Executive (unsponsored/sponsored)
    • Investor (unsponsored/sponsored)
  • Business Skills (Residence) Class DF
    • Business Owner (unsponsored/sponsored)
    • Investor (unsponsored/sponsored)

KEY FEATURES OF BUSINESS SKILLS VISA SUBCLASS

  • More emphasis on State/Territory sponsorship at Provisional and Permanent stages.
  • Lower level criteria for all sponsored categories.
  • State/Territories can sponsor who they wish in line with economic development objectives.
  • No points test.
  • Age Limit (45 and 55)

COMMON CRITERIA FOR PROVISIONAL VISAS (UNSPONSORED SUBCLASSES)

  • Vocational English
  • Age - less than 45 years
  • Need to be temporary resident in Australia
  • Commitment to business/investment in Australia
  • No adverse business history
  • Sound health and good character
  • Notification of State/Territory Department (Form 927)
  • Signed Declaration

COMMON CRITERIA FOR PROVISIONAL VISAS (SPONSORED SUBCLASSES)

  • No English requirement
  • Age – less than 55 years with waiver option
  • Sponsorship Form 949 signed by appropriate authority
  • Commitment to business/investment in Australia
  • No adverse business history
  • Signed declaration
